Judge pushes back timeline for tariff refunds

New York, NY --

On March 6, 2026, CIT Judge Eaton issued a second order in response to CBP Executive Director Brandon Lord's Declaration concerning the ACE system's capacity to issue refunds.  As a result, Judge Eaton directed CBP to submit a report to the Court advising progress toward development of refund process for IEEPA duties.  Read the order here.

64% of all entries are informal entries which liquidate immediately. Approximately 4 million informal entries will  automatically liquidate by March 16. 15 million entries are beyond the CBP 90 day reliquidation period.

CBP shall liquidates entries without IEEPA. Liquidated entries that are not final shall be re-liquidated without IEEPA.
